On August 28, 2025 the Department of Homeland Security published the proposed rule to end ‘duration of status’ (D/S) for F, J, and I non-immigrants.

This proposed rule would eliminate the current rules around D/S for international students, scholars, employees, and visitors. It would instate a fixed date of entry, along with a formalized process for requesting extensions.

This proposed rule is not in effect. When a final rule is published, further guidance will be provided.


What is Duration of Status?

Duration of Status or D/S has been policy for over 30 years. It allows F, J visa holders flexibility in staying in the U.S. through the end of their studies, work or academic objective without needing to file an extension through the federal government.

When an F or J visa holder enters the U.S. they are given the designation of D/S until a specific ‘admit until’ date as other visa types are given. D/S allows an F or J visa holder their ability to remain in the U.S. as long as they are maintaining their status through
