Presidential Proclamation: RESTRICTION ON ENTRY OF CERTAIN NONIMMIGRANT WORKERS
On September 19, 2025 a presidential proclamation was published titled ‘Restriction on Entry of Certain Non-Immigrant Workers’. As of the publishing of this information the following is the information that the WFU community should be aware:
The President issued a proclamation introducing a $100,000 entry fee for certain H-1B workers.
USCIS has issued a subsequent memorandum clarifying that the additional $100,000 entry fee applies only to future H-1B petitions. This means that the proclamation does not affect:
- Petitions that were already filed (prior to the effective date of September 21, 2025).
- Petitions that have already been approved; or
- Individuals who already hold valid H-1B visas.
Current H-1B visa holders may continue to live, work, and travel without restriction.
Implications for current H-1B visa holders:
- If you already hold a valid H-1B visa stamp in your passport, you may continue to work, and travel to enter and re-enter the United States as before.
- If you are the beneficiary of an approved H-1B petition filed before September 21, 2025, the proclamation does not apply to you.
The proclamation does not limit or restrict travel for individuals with valid H-1B visas.
